TERMS & CONDITIONS

​PRODUCTS

1.1 All products depicted on this website may vary due to seasonal availability. 

1.2 Certain flowers and plant products may be delivered in bud to ensure longer life - this means they may appear different to the images used on this website or any Flourish & Bloom social media pages

1.3 Some flower and plant products may be harmful or poisonous (lilies in particular can be extremely toxic to cats). If you require further information before submitting an order please visit our "Contact Us" page.  

1.4 All products are subject to availability. In the event of any supply difficulties, we reserve the right to substitute with a product of equivalent value and/or quality without notice. Where possible we will contact you with any major changes.

1.5 In the event that we are unable to supply all or part of your order (the product or any substitute product to you at all), we shall notify you as soon as possible and we can either rearrange for another delivery date or reimburse your payment in full no later than 7 days after the intended delivery/collection date.

1.6 We guarantee the freshness of your flowers for 7 days from the date of delivery/collection providing all care instructions have been followed.

1.7 In order to place an order we require your name, email address, payment details and the details of the order. We will store the details of your order on our systems in order to process your order.

1.8 Flourish & Bloom reserve the right, at our absolute discretion, to reject any order without giving reasons. In the event of rejection, we will refund or cancel any payments received in full, via the payment method used to place the order.

1.9 As a part of the ordering process you will be able to select the delivery date for your order we reserve the right to change the date if the product is unavailable and will contact you to confirm you are happy with the date change. A refund would be given if you are unhappy with the next available delivery date.

PRICES

3.1 Prices listed on the Flourish & Bloom website/Facebook/Instagram are valid for a maximum of 7 days from the date of submitting your order.

3.2 Prices stated do not include delivery fee (This is shown when you are checking out)

3.3 Delivery charge is the same price for all of this isle of man

3.4 Please note that from time to time, product and delivery prices on flourishandbloom.net may vary to those offered via telephone ordering or social media ordering. 

3.5 Product prices are subject to change without notice.

PAYMENTS

4.1 We will require you to provide us with your personal details, including accurate postcode, together with those of the intended recipient and all necessary payment details.

4.2 We accept payment by Debit & Credit Card Payments

4.3 By clicking on the 'Pay Now' button at the end of the order process, you are consenting to be bound by our Terms and Conditions contained in these terms and conditions and appearing anywhere on the website.

4.4 Submitting your order is subject to us accepting this offer. We will send an email confirmation of your order details to advise that we are have accepted your order via the email address you provide. We will not consider ourselves bound by a contract with you until we have issued this email confirmation.

4.5 We cannot accept orders from customers under the age of eighteen (18) years.

DELIVERY

5.1 All products are only available for delivery on the Isle of Man and a delivery fee will apply

5.2 All current delivery dates will be available to select when placing your order. If you want to make a future order please keep checking the website for newly added dates or contact us via our contact form or Facebook page.

5.3 To avoid problems or delays with delivery, please ensure that you have included the full address details, including accurate postcode of the intended recipient and telephone number, together with your daytime contact telephone number or email address so that in the event of any delivery problems being encountered. Flourish & Bloom may contact you to confirm any delivery details.

5.4 In the case of delivery to certain locations, where a third party is involved, such as offices, hospitals, funeral directors, airports, hotels, ships and other business locations, please ensure delivery will be accepted at the location before placing the order.

5.5 Please be aware that we will deliver the goods to the address provided in good faith and we cannot accept responsibility if the intended recipient is no longer at that address and the receiver refuses or fails to return the items(s).

5.6 Please note that if unable to find someone to accept delivery, or unable to leave the delivery in a secure location, we will leave a card at the address for the recipient to make contact and re-arrange delivery. If the recipient fails to make contact in good time (1 day) we reserve the right to charge for re-delivery to that or an alternative address.

5.7 We shall not be liable for any failure to perform in our obligations where such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout, pandemic, lockdown or interruption or failure of electricity or telephone service.

CANCELLATIONS/AMENDMENTS

5.1 If for any reason you wish to change or cancel your order, please contact us via email and provide the following information:

  • Order number

  • Name & Billing address of customer

  • Name of recipient

Please give 24 hours notice before the intended delivery date

5.2 We regret that you can not cancel your order once is has been dispatched for delivery and a refund would not be possible due to goods being perishable.  

5.3 You are entitled to cancel any payment at any time where fraudulent use has been made of your credit or debit card by another person not acting on behalf of you or as your agent and to be re-credited by us to the extent that such sums are not reimbursed by the card issuer in such circumstances.

DISCLAIMER

6.1 Whilst we agree to use all reasonable measures to ensure that the Website is fully operational and error-free, we cannot guarantee this and therefore accept no responsibility for any defects and/or interruption of the Website and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the Website impossible or impractical.

6.2 Subject to clauses 1.5 and 4.3, we shall not be liable for any delay or inability to perform our obligations to you if such delay is due to any cause whatsoever beyond our reasonable control.

6.3 Abuse of Service: We reserve the right to refuse an order if we believe your use of our service (Flourish & Bloom)  either directly or indirectly, is for any unlawful purpose, or, may cause distress or offence to any person.

6.4 Flourish & bloom understands that it is under a legal duty to supply goods that are in accordance with the contract.

Customer Service

7.1 In the event you are not satisfied with your product, please contact us and we'll do all we can to put the situation right.

7.2 Because of the perishable nature of our products and in order to assist us in resolving any complaints quickly and to our mutual satisfaction, we advise you to make any complaint within 1 working day of the date of delivery or intended delivery of your purchase.

GENERAL

8.1 We reserve the right to amend these Terms and Conditions at any time and it your responsibility as the customer to review these terms and conditions each time you visit the website. 

8.2 We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions and as stated in our Privacy Policy.

8.3 We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998.
